Dispute resolution

We assist Swiss and international clients in civil, administrative and criminal disputes, particularly in the commercial, banking and financial fields.

We advise our clients before Swiss courts and arbitral tribunals, as well as in bankruptcy and enforcement proceedings. We have extensive experience in international litigation and regularly assist our clients in proceedings for the recognition and enforcement of foreign judgments or arbitral awards.

We assist our clients in all phases of the dispute:

Pre-litigation phase: analysis of the risks and chances of success of a possible procedure; identification of a possible external source of financing (third party funding) and negotiation of the financing contract; correspondence with the opposing party, notification of a claim and management of contacts with insurers.

Litigation phase: drafting of judicial or arbitration documents, management of all phases of the proceedings, hearings, expert opinions, hearing of witnesses, pleadings, as well as possible out-of-court negotiations, insofar as these are in the interest of the clients.

Post-litigation phase: enforcement of judgments or arbitral awards.

Our practice includes in particular:

  • Analysis of the risks and chances of success of potential proceedings
  • Pre-litigation correspondence
  • Filing of requests for provisional and pre-provisional measures
  • Conduct of civil, criminal and administrative proceedings before all levels of court
  • Conduct of arbitration proceedings
  • Recognition and enforcement of foreign judgments
  • Negotiation and conclusion of out-of-court agreements
  • Handling of claims notifications to liability insurers in connection with court or arbitration proceedings
  • Management of third party funding
